RESPONSIBILITY

Photo Workshop Adventures LLC (PWA) will provide educational and creative enrichment for PWA Photography Adventure Tours, Workshops, and Private Guided Tours as outlined on this website as a sponsoring organization and has qualified professional guides, instructors, and tour operators to organize and administer PWA Photography Adventure Tours, Workshops and Private Guided Tours. The designated tour operator(s), in turn, acts only as an agent for any transportation carrier, hotel, ground operator, or other suppliers of services connected with these tours (“other providers”), and the other providers are solely responsible and liable for providing their respective services. The passenger tickets in use by the carriers shall constitute the sole contract between the carriers and the passenger; the carriers are not responsible for any act, omission, or event during the time participants are not aboard their conveyances.

Photo Workshop Adventures and its designated tour operator(s) and tour administrator(s) shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of; persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, pandemics, theft, or any other cause(s) beyond their control. The participant waives any claim against Photo Workshop Adventures and/or its designated tour operator(s) and tour administrator(s) for any such loss, damage, injury, or death.

By registering for a PWA Photography Adventure Tour, Workshop and Private Guided Tour, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants; and they are aware of any associated risks created by field locations, activities, and weather; that they agree to follow the instructors’ directions, particularly in matters of personal and group safety, including but not limited to the importance of hydration, need for nutritious snacks, altitude sickness, exhaustion, leave no trace, sunscreen, bug dope, the danger of overhangs, footing, vehicle safety, boat safety, hot air balloon safety, helicopter safety, watercraft, and ferry safety, common-sense safety, respect for others, etc. Photo Workshop Adventures and its designated tour operator(s) reserve the right in their sole discretion to accept, decline to accept, or remove any participant on a PWA Photography Adventure Tour, Workshop, or Private Guided Tour. Photo Workshop Adventures and the tour operator(s) reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of participants.

Neither Photo Workshop Adventures, its designated tour operator(s), nor its tour administrator(s) shall be liable for any air carrier’s cancellation penalty incurred by the purchase of a nonrefundable ticket to or from the participant’s PWA Photography Adventure Tour, Workshop or Private Guided Tour departure city. Baggage and personal effects are, at all times, the sole responsibility of the participant.

TERMS AND CONDITIONS

Basis of Rates: All prices are based on (an industry standard) double occupancy (two persons sharing a room). All prices and fares are quoted in U.S. dollars. The rates are based on current tariffs and are subject to change due to unforeseen circumstances. While we will do everything possible to maintain the listed prices if it is necessary to levy a surcharge, we reserve the right to do so, and notification will be given at the time of final invoicing.

Eligibility: Participants in a PWA Photography Adventure Tour, Workshop, and Private Guided Tour must be 18 or over and have full mobility. Anyone under 18 must be accompanied by a parent or guardian for the entire journey.

Included in Tour Cost: Accommodations and meals as indicated in the itinerary (B = breakfast, L = lunch, D = dinner); pre-departure information; and destination sightseeing noted as included in the itinerary, unless otherwise noted on the itinerary page; ground transportation during the tour; transfers to and from group flights where applicable; services of Photo Workshop Adventures leaders, experts, lecturers, guides, fixers, tour manager, and any other staff. Please note: the “B, L, D” notations apply to the period during the tour only and do not include any meals on flights to/from the trip. Internal airfare is included on some international tours, as indicated in the itinerary. Note: Although breakfasts may be listed as included, some hotels do not offer packages that include breakfast. Photo Workshop Adventures, its partners, travel agents, or tour operators always book the best accommodations based on the group and never compromise the quality of the hotel for the benefit of a pre-determined meal plan.

Not Included: Air or ground transportation to and from the photo adventure destination and related fees (except as indicated in the itinerary); activities noted as excursions and/or noted as optional in the itinerary; gratuities, unless otherwise noted on the itinerary page; passport and visa expenses; baggage/accident/cancellation insurance; personal expenses, such as laundry, mobile phone use, and alcoholic beverages; and any other items not specifically noted as included.

Accommodations: Photo Workshop Adventures reserves the right to change accommodations based on our final attendance count, pricing, and other factors that might influence our decision. We typically stay in hotels in the 4-star category, sometimes in the 5-star category. Not all destinations offer these types of properties. We look for unique hotels which offer cultural, historical, and/or authentic features. Depending on the size of the group, smaller boutique hotels may have limited room inventory. In some countries or in remote locations, we may be limited to lodges, Casas, riads, bed and breakfasts, or branded chain hotels of lesser quality. If we decide to operate a tour with three (3) or fewer guests, we reserve the right to select accommodations that work within our budget. This could mean that we downgrade the hotels to a lesser category. Although this rarely happens, we reserve the right to potentially make these changes. Breakfast is included only if included in our room rates.

Single/Shared Accommodations: We do not offer shared rooms for guests who do not know each other. If you are not sharing a room with a partner, spouse, friend, or family member, you will be required to travel as a single and pay the single supplement fee.

Early Arrival and Late Departure Accommodations: We offer our guests the convenience of booking early arrival and late departure hotel rooms. We base the price of these accommodations on an average amount we expect to pay for the hotel room in any of the hotels we may consider using. It is not our intention nor our objective to profit from these hotel bookings; however, prices may be listed a year or more in advance, so the price we pay can be +/- the actual price listed. Rooms are typically in the superior or deluxe categories. We highly recommend that our guests reserve early arrival or late departure rooms through PWA for their own convenience and the convenience of the group.

Payments, Cancellations, and Refunds: To reserve space on a PWA Photography Adventure, Tour, or Workshop, a minimum $1000 per person deposit is required. Some photo adventures require a higher deposit. Final payment is due no later than 180 days prior to departure. Balance payments may be made by international or domestic bank wire or bank check (U.S. Citizens only). Balance payments may also be made by credit card or PayPal to a maximum amount of $7,000 per registration. If paying by credit card, a credit card or bank card convenience fee of 3.5% will be applied to balance payments. Your non-refundable reservation may be canceled if full payment has not been received by 150 days prior to departure. For reservations made within 120 days of the departure date, full payment is required within five business days of the reservation. All cancellation notices must be received in writing and will become effective as of the date of the postmark (standard mail or electronic). If you cancel 180 days or more prior to departure, you will receive a full refund. Per-person charges for cancellations that occur less than 180 days prior to departure (“Cancellation Penalty Period”) are as follows: 150-179 days prior to departure: 75% refund on the total trip cost, less an administrative fee of $400 per person; 121-149 days prior to departure: 50% refund on the total trip cost, less an administrative fee of $400 per person; 120 or fewer days prior to departure: no refunds. This policy also applies to pre- and post-trip extensions, excursions, early arrival rooms, and late departure rooms. Any revisions made within the Cancellation Penalty Period, such as a change in departure date or choice of trip, are subject to this cancellation policy. Any airline tickets issued are subject to the carrier’s refund policy. Leaving a tour in progress for any reason whatsoever will not result in a refund, and no refunds will be made for any unused portions of a tour. PWA reserves the right to cancel any trip because of inadequate enrollment that makes the trip economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If a tour is canceled prior to departure, the tour operator will provide you with a full refund of monies paid to the tour operator, except in the event that the cancellation is due to a significant event that makes it unfeasible to operate the tour as planned, in which case the tour operator will provide you with a refund and/or credit toward a future PWA Photography Adventure Tour, Workshop or Private Guided Tour equivalent to monies paid to the tour operator. Should we have to cancel the trip in progress, you will receive a prorated credit based on the number of days not completed on the tour. PWA will not be responsible for any refund for nonrefundable airline tickets or for any airline tickets purchased by the passenger directly from an airline or travel agent. All refunds are subject to the rules of our credit card merchant servicing provider, “PayPal,” which processes all credit cards and debit cards in addition to PayPal payments. In 2019, PayPal merchant services discontinued applying a 100% refund to its merchants (e.g., PWA), essentially meaning that the 3.5% merchant services fee they collect for PWA will not be returned to PWA when a refund is processed. For this reason, all credit card refunds will be issued less the 3.5% fee PWA is unable to recover from our credit card merchant servicing provider, “PayPal.” Refunds will be processed within 10-15 business days from the date the refund is approved. PWA recommends travel insurance to protect your investment.

Group Registrations: Couples or groups of guests, three or more, who register are subject to a 180-day non-refundable clause. Because PWA typically takes no more than six guests on tours, PWA cannot manage a last-minute cancellation of 3 or 4 guests who could essentially cancel the trip for all other guests who are registered and cost PWA unrecoverable monies that may be due. For this reason, PWA reserves the right to collect non-refundable balance payments from each guest a full 180 days before the trip start date to ensure that the guests are 100% committed to the trip. If the guest thinks there is any reason for a potential cancellation, we recommend trip insurance to protect their investment.

To reserve space on a PWA Custom Designed Private, Group Adventure, Photo Safari, Polar Expedition, Cuba Photo Adventure, Group Festival Adventure, and/or Private Guided Photo Adventure, final payment is due no later than 180 days prior to departure. This includes all Photography Adventures, Tours, or Workshops that include annual festivals such as Semana Santa, Venice Carnival, Oaxaca Day of the Dead, Holy Week, or any one-off / one-time photo adventures. Payments for Private Guided Photo Adventures may only be made by bank wire or bank check. Your reservation may be canceled if full payment has not been received by 180 days prior to departure. For reservations made within 180 days of the departure date, full payment is required within five business days of the agreed and signed proposal. All cancellation notices must be received in writing and will become effective as of the date of the postmark (standard mail or electronic). If you cancel 210 days or more prior to departure, you will receive a full refund. Per-person charges for cancellations that occur less than 210 days prior to departure (“Cancellation Penalty Period”) are as follows: 181-209 days prior to departure: 75% refund on the total trip cost, less an administrative fee of $400 per person; 151-180 days prior to departure: 50% refund on the total trip cost, less an administrative fee of $400 per person; 150 or fewer days prior to departure: no refunds. We reserve the right to cancel any trip because of inadequate enrollment that makes the trip economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If a tour is canceled prior to departure, the tour operator will provide you with a full refund of monies paid to the tour operator, except in the event that the cancellation is due to a significant event that makes it infeasible to operate the tour as planned, in which case the tour operator will provide you with a refund and/or credit toward a future PWA Photography Adventure Tour, Workshop or Private Guided Tour and/or Private Guided Photo Adventure equivalent to monies paid to the tour operator. We will not be responsible for any refund for nonrefundable airline tickets or for any airline tickets purchased by the passenger directly from an airline or travel agent. All refunds will be processed within 10-20 business days from the date the refund is approved. We suggest travel insurance to protect your investment.

Photo Day Tours: Payments are due in full at the time of registration. Cancellations within seven days of the Photo Day Tour date are non-refundable. All cancellation notices must be received in writing and will become effective as of the date of the postmark (standard mail or electronic). Reservation dates may be changed no less than seven days prior to your photo day tour date. It is the guest’s responsibility to arrive at the correct pickup location prior to the scheduled pickup time. No-shows will be charged in full. All refunds will be processed within 10-20 business days.

New York Aerial Doors-Off Photo Adventure or Experience: Payments are due in full at the time of registration. Cancellations within 48 hours of the New York Aerial Doors-Off Photo Adventure or Experience date and time are non-refundable. All cancellation notices must be received in writing and will become effective as of the date of the postmark (standard mail or electronic). Reservation dates and times may be changed no less than 48 hours before the New York Aerial Doors-Off Photo Adventure or Experience date and time. All refunds will be processed within 10-20 business days.

Rescheduling: We realize that your plans may change due to unforeseen circumstances. For this reason, travel insurance should be considered to protect your investment. Should you need to cancel and you are within a penalty period, contact PWA and explain your situation (email is best). It’s not always possible to make adjustments, but we will try our best to find a solution. We cannot be responsible for unrecoverable expenses such as non-refundable accommodations, cancellation fees, flights and/or flight cancellation fees, tour partner fees, etc. No rescheduling will be allowed within 90 days from the trip start date.

Weather: We reserve the right to cancel, reschedule or re-route a PWA Photography Adventure Tour, Workshop, Private Guided Tour, or Photo Day Tour up until the last minute due to inclement or unsafe weather conditions, safety, or other uncontrollable circumstances. For Photo Day Tours, we will try to reschedule or adjust to a more accessible destination or, if necessary, issue a full refund. New York Aerial Doors-Off Photo Adventure or Experience flights will be rescheduled or canceled if the weather conditions are not acceptable for the flight. Cancellations will receive a full refund. All refunds will be processed within 10-20 business days.

Travel Insurance: Photo Workshop Adventures recommends purchasing travel insurance to protect you and your investment in the event of an eligible sudden emergency before or during your trip and coverage for trip cancellation or interruption, illness, injury, and damage, loss, or theft of baggage, as well as emergency assistance. Some travel insurance companies require guests to secure and pay within 30 days of the final payment. This applies to deposits and balance-due payments. Travel insurance can be purchased through Photo Workshop Adventures. Photo Workshop Adventures is proud to offer insurance plans from Travelex and Medjet. Plans available vary by country and state of residency; please contact Photo Workshop Adventures and reference travel insurance, or for more information online, visit https://photoworkshopadventures.com/travel-insurance

Photographer Leaders: The itineraries and staff presented on this website are subject to modification and change by Photo Workshop Adventures or its designated tour operator(s). Every reasonable effort will be made to operate programs as planned, but alterations may still occur after final itineraries are sent. Photo Workshop Adventures makes every attempt to provide photographic opportunities in the best possible light, but this is often compromised by daily itineraries and travel schedules. Since the best light is just after sunrise and just before sunset when the sun is low, it is impossible to visit all locations during these limited hours. Photo Workshop Adventures makes every attempt to instruct and inspire throughout a photo adventure. It is important that you arrive with a working knowledge of your camera’s settings. Your photographer leader will be photographing alongside you. We believe in “lead by example” teaching techniques. Photo Workshop Adventures does not provide any classroom instruction. Instructions are conducted on-site using walk-n-talk techniques. Don’t be afraid to ask questions and ask your photographer leader when you need help. Photo Workshop Adventures makes no guarantees that you will become a better photographer.

Accommodations: Photo Workshop Adventures reserves the right to change accommodations based on our final attendance count, pricing, and other factors that might influence our decision. We typically stay in boutique hotels in the 4-star category and sometimes in 5-star properties. This could mean that we downgrade the hotels to a 3-star category. Although this rarely happens, PWA reserves the right to potentially make these changes. Breakfast is included only if included in our room rates.

Loyalty Rewards Program: All rules governing the PWA loyalty rewards program are as stated on the PWA website on the loyalty rewards page. The maximum dollar amount per reward redemption is fifteen hundred dollars ($1250) per trip per guest or two thousand dollars ($2000) per trip per couple traveling together, whether double or single occupancy. A trip is defined as a PWA group Photography Adventure Tour, Workshop, or similar that is five days or longer in duration. Loyalty points may not be used on any private guided tours.

Health Requirements: You must be in good physical and mental health. Mobility is important. You must be able to maintain the pace of the group throughout the tour. Any physical condition, diet, or treatment requiring special attention must be reported in writing when you register. Failure to participate in daily activities due to physical or mental health will not result in any refund and/or credit. For special dietary requirements, we do our best to convey this information to restaurants and food establishments, but communication of these requirements to restaurants and food establishments is ultimately your responsibility.

Content and Social Media: We reserve the right to take photographs or videos during the operation of any tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. While attending a PWA Photography Adventure Tour, Workshop, or Private Guided Tour, the participant agrees to allow his/her likeness to be used by Photo Workshop Adventures, Photo Workshop Adventures-authorized third parties, and the Tour Operator(s) without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the trip. Copyright in all photographs, videos, and related materials created by the participant (“tour Materials”) shall belong to the participant upon creation. The participant grants to Photo Workshop Adventures a non-exclusive, worldwide, irrevocable license to use any tour Materials provided to Photo Workshop Adventures and/or the Tour Operator in any media for the following limited purposes: editorial use, promotion of this editorial use, promotion of Photo Workshop Adventures travel programs, or promotion of the mission of Photo Workshop Adventures.

Infectious Disease Outbreak: Any photo adventure, tour, or trip adversely affected by an infectious disease outbreak, such as N1H1 (swine flu), COVID-19 (novel coronavirus), or any other epidemic or pandemic ordered by the CDC (Centers for Disease Control and Prevention), or the WHO (World Health Organization), may be postponed and rescheduled. If your tour is rescheduled, all registered guests will be offered three options: 1) reschedule the same photo tour (same destination) on a future date, based on availability; 2) select a different photo tour in the future, and your payment will be applied to the new tour. Your account will be reconciled with either a credit or an additional balance due, depending on the new tour price; or 3) you may take your time deciding on a future tour. Your deposit or payment will be kept in your account until you let us know when you would like to travel. PWA reserves the right not to allow cancellations for any group or private photo adventures, tours, or trips that fall beyond PWA’s designated pandemic postponement timeline and for a period of up to twenty-four months after an infectious disease outbreak is ordered a pandemic. Guests who choose to cancel will be offered a postponement and an opportunity to reschedule using the three options listed above. Sudden infectious disease outbreaks can significantly impact businesses worldwide. As a small business in the international travel sector, PWA is not in a position to provide mass guest refunds. Unfortunately, we cannot make any exceptions to our ‘no refund policy’ related to infectious disease outbreaks. We understand your concerns, and safety is our first priority.

Note: All credits issued as a result of the WHO-mandated (March 2020) Covid-19 pandemic will expire on December 31, 2023. All covid related credit must be applied to PWA Photography Adventures, Tours, or Workshops, including Private Photo Tours, by December 31, 2023. All trips must be completed by the end of the 2023 calendar year.

Force Majeure: Photo Workshop Adventures will not be liable for any delay in, change to, or cancellation of trips due to ‘Force Majeure.’ ‘Force Majeure’ means a circumstance beyond the reasonable control of Photo Workshop Adventures and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, pandemic, epidemic, industrial or nuclear disaster, adverse weather conditions, fire, strikes, or similar.

Dispute Resolution: If the participant has a complaint, he/she should first inform the adventure leader or tour operator while on the adventure so that the adventure leader or tour operator can attempt to rectify the matter. If the participant is still dissatisfied, he/she should submit the complaint in writing to Photo Workshop Adventures within 30 days of the completion of the adventure. Any controversy or claim arising out of or relating to this Agreement, website, brochures, or any other literature concerning this adventure, or the breach thereof, including without limitation any claim related to illness, injury, or death, shall be subject to the following conditions: 1) the dispute will be governed by New York State law; 2) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including without limitation the validity, interpretation, performance, and breach hereof, through a process of mediation in the state of New York, county of Suffolk. Under the supervision of a mutually agreed-upon mediator; 3) in the event that mediation fails to settle such a dispute, the parties agree that they will proceed to arbitration in the state of New York, county of Suffolk. Using one arbitrator pursuant to the then-existing rules of the American Arbitration Association; 4) the maximum amount of recovery to which a participant will be entitled under any and all circumstances will be the published cost of the participant’s adventure with Photo Workshop Adventures. This agreement to arbitrate does not waive or modify any liability release agreed upon by the participant.

Other: Other Terms and Conditions may apply to some tours and will be provided with pre-trip emails or mailings. By registering for a PWA Photography Adventure Tour, Workshop, or Private Guided Tour, the participant agrees to the Responsibility statement and the Terms and Conditions herein.
